Introduction
Oust Labs, Inc. (“Oust” or “we” or “us” or “our”) takes your privacy and the security of your personally identifying information (“Personal Information”) very seriously. This Privacy Policy (“Policy”) is to provide you with notice regarding how we collect, use, protect, and disclose your Personal Information, Usage Data (as defined below) when you use the Oust Web and Mobile Applications (Oust Apps) or visit the Oust website (“Services”).
By using the Oust Apps you consent to this Privacy Policy. Oust is not responsible for the privacy practices, of any company that Oust does not own or control, or for individuals not employed or managed by Oust.
Information We Collect
Personal Information
We may collect Personal Information that you provide to us, such as your name, phone number, address and email address. With your permission, we may also access other information on your device, such as your phone book or messages, in order to provide services to you. If authorized by you, we may access profile and other information from services such as Twitter, Facebook and Google+.
Information Provided by User
You provide certain Personal Information such as your email address, mobile number and mobile device and computer information to Oust when you create an account on the Oust Apps. The decision to provide this information is not mandatory. However, if you choose not to provide this information, you may be unable to take advantage of all features on the Oust Apps. When you install the Oust Apps, certain Personal Information will be stored on our servers to help us provide you with the best user experience possible.
Usage Data
Oust collects usage information that does not identify an individual user but allows Oust to gather information relating to how the Oust Apps are used. (“Usage Data”).
Location Information
In serving you, we may use or store your precise geographic location, if you give us permission to do so. We do not use or share this data for any other purpose. Many devices will indicate through an icon when location services are operating. We only share this location information with others as are approved by you.
How We Use and Share Information
At times, we may share your information with third parties for different reasons. The information made available to other companies depends on the nature of our relationship with them. We generally require other companies to keep our users’ information confidential. The use and disclosure of non-Personal Information is not subject to any restrictions under this Policy.
Compliance with Laws and Law Enforcement
We may release Personal Information and/or non-Personal Information in order to comply with the law if required to do so by law, or in the good-faith belief that such action is necessary to comply with state and federal laws, international law or respond to a court order, subpoena, or search warrant or equivalent, or where in our reasonable belief, an individual’s physical safety may be at risk or threatened. Oust also reserves the right to disclose Personal and/or non-Personal Information when Oust believes it is necessary to enforce our Terms of Service, take precautions against liability, to investigate and defend ourselves against any third-party claims or allegations, to protect the rights, property, or personal safety of Oust, Oust Apps users or others.
Analytics Services Provided by Others
Oust uses Google Analytics to help us anonymously track and report user/visitor behavior information and users’ standard log information to our website and the Oust Apps. Analytics companies may access anonymous data (such as your IP address or device ID) to help us understand how our services are used. They use this data solely on our behalf. They do not share it except in aggregate form; no data is shared as to any individual user.
In the Event of Merger or Sale
In the event that Oust goes through a business transition, such as a merger, third party acquisition, a sale of all or a portion of our assets, or other change of control, Personal Information may be among the assets transferred or sold and we may not be able to control how your personal information is treated, transferred or used.
Push Notifications/Alerts
We may use Push Notification Services to notify you about messages. If we do, the phone number or the name of the person calling you may be part of the notification. This message is sent to the push notification service provider, for delivery to your service.
Update to Account Information
You can contact us by email at privacy@oustme.com to request to see, change or delete your personally identifiable information that we have stored.
Security
Oust takes reasonable measures to protect and safeguard your Personal Information from loss, misuse, theft and unauthorized access. Despite our best efforts, we cannot guarantee 100% security of any information that is transmitted through the Oust Apps. Any information you transmit through our Services is transmitted at your own risk. You are responsible for maintaining the confidentiality of your Personal Information on your computer and mobile device and for restricting access to said device through which you access the Oust Apps. If you share your computer or mobile device with other people, you take full responsibility for their actions.
Special Note to International Users
Please take note that if you are a user accessing the Oust website or using the Oust Apps from the European Union, Asia or any other region with laws or regulations governing personal data collection, use, and disclosure that differ from the laws of the United States, please be advised that through your continued use of the Oust website and/or Oust mobile App, which are governed by California law, this Privacy Policy and our Terms of Service, you are transferring your personal information to the United States and you expressly consent to that transfer and consent to be governed by California law for these purposes.

We may choose to periodically revise this Policy and this will be indicated by the “revised date” listed above. You may visit this page to be made aware of any changes. By continuing to use the Oust website and/or Oust App, you agree to be bound by the revised Privacy Policy and any changes made to the same.
